WA Health Exchange Bill Reduces Choices for Employers: Call & Write your legislator

Engrossed Second Substitute House Bill 2319 passed the Legislature on March 3 and is awaiting review by the governor. The bill further defines the state-based health insurance exchange required by the federal government under the new health care law. As written, E2SHB 2319 would eliminate employer choice over the type of coverage purchased and reduce the number of insurers offering coverage in our state. WA HR Pending Legislation Report - February 15, 2012

Most employment –related bills proposed this session did not pass yesterday’s cut-off date to pass out of their house of origin.  While technically not completely dead, they are extremely unlikely to make any further movement.  Among the zombies are:  Anti Workplace Bullying (1928 , 5789)  and Statewide Sick & Safe Leave (2508 , 6229) and pro biz bills. Three exceptions that made it out: SB 6228, prohibiting certain practices concerning the employment status of job applicants, i.e. the Unemployed as a protected class. HB…Continue

9th - Employee vs. Independent Contractor question  decided by California public policy and choice of law rules, not parties' contract language.Ruiz v. FMLA Changes Proposed The U.S. Department of Labor has issued a notice of proposed rulemaking to implement new statutory amendments to the Family and Medical Leave Act (FMLA) that would expand military family leave provisions and incorporate a special eligibility provision for airline flight crew employees. Key term: FMLA CHANGES PROPOSED in the Benefits section VOW Tax Credits: Hiring Unemployed Vets President Obama signed into law the Veterans Opportunity to Work (VOW) to Hire Heroes Act of 2011. A section of the Act, the “Returning Heroes and Wounded Warriors Work Opportunity Tax Credits,” amends and expands the definition of Work Opportunity Tax Credit’s Veteran target groups. Chaney Case: FMLA, Certification & Duty to Return to Work

In the December 20, 2011 case of Chaney v. Providence Hospital (Wash. Ct. App. Div III) the Court of Appeals held that a doctor's certification of fitness to return to work is all that is needed to trigger an employer's duty to return employee to work, despite the employer's contradictory  IME determination.Continue

National SHRM NLRB Action Alert

NLRB Action AlertThe National Labor Relations Board (NLRB) recently issued a proposed rule changing the Board’s procedure for union election campaigns.  The proposal shortens the time frame for union election campaigns and makes other changes to the unionization process.  The proposed rule contains a number of provisions of concern including:• Shortened Timeframe.  Because unions can prepare their entire unionization campaign before making it public, shortening the time between filing and the election creates a disadvantage for employers.  Unless employers have adequate time to prepare their educational materials, employees will not have full information about the pros and cons of unionization.  In addition, the NLRB has not shown why the current timeframe (median of 38 days) needs to be shortened. • Changes to…Continue

Please urge your representative to vote yes on H.R. 2587, the Protecting Jobs from Government Interference Act. Background The Boeing Company decided in 2009 to expand its 787 Dreamliner aircraft production capacity outside of Washington State by investing in a new assembly plant in South Carolina.
